* Services or Websites that are not allowed to be hosted on any of our Virtual Private Servers:
We do not allow fraud websites, phising sites, spamming, gambling websites, nulled scripts, IRC, warez hosting/storage (for any reason or method), warez linking, child porn, racist content, any torrent-related sites or services (if illegal).
- We ask for a fair usage of CPU on our VPS services
- We reserve the right to cap your VPS CPU at anytime if you cause major disruption to other customers on the same node as you. If your VPS still continues to cause major disruption to other customers on the same server node as you after capping your CPU, we reserve the right to suspend your VPS.
We do have a 5 day money back guarantee here at AeroVPS. However, due to abuse, we only refund if the service has been down for over the uptime guarantee. (Excluding network maintenance and hardware upgrades) We have the right to refuse any refunds to anyone, at anytime.
We have a zero-tolerance for Paypal/Credit Card disputes here at AeroVPS. If you are found to open disputes, unautorized claims, or chargebacks, your service may be terminated without any refunds at all.
Any attempt to undermine or cause harm to a server or customer of AeroVPS is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be terminated without a refund.
We deny heavy IO programs to give fair usage to clients across the board, for example rtorrent and deluge. We reserve the right to suspend or terminate any service using too much resources, for instance 60% iowait. Running torrent or peer-to-peer applications on a VPS that's not been prepackaged by AeroVPS to do so will result in immediate suspension and possibly termination. This goes along-side without any refund.
- We reserve the right to refuse, cancel or suspend service, at our sole discretion.
- If you attempt to DoS or DDoS our services, you will be severely punished and will be terminated automatically with no refunds.
- We have the right to refuse service to anyone at anytime.
- Our VPS plans may not be used for any of the following scripts unless there is a VPS plan that is pre-packaged with the restricted script, where the user must order that specific plan. We do not allow users to setup these scripts themselves, and we reserve the right to terminate the VPS if this term is not followed. The scripts that's been disallowed on our network are: Torrent Downloader Scripts, IRC bot scripts, Web Proxies. Unless special permission has been granted.
* Abuse and Network Interruption
- If your service has been found to having abused the network, so severely that NOC (Networking Operations Center) of the DC (data center) recommends, or pro-actively takes our node(s) offline to prevent further attacks, you will be held responsible to pay a penalty fine, you will be notified immediately of the abuse and a fine will be determined once services have been restored. Fines/Penalties may reach up to $1000, and you will be held responsible to pay the penalty as per this agreement.
We DO NOT refund partial fees to accounts on cancellations.
* Limitation of Liability:
AeroVPS shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from AeroVPSs' servers going off-line or being unavailable for any reason whatsoever. Furthermore, AeroVPS shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of AeroVPSs' servers. All damages shall be limited to the immediate termination of service.

AeroVPS cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by AeroVPS are resold. Thus, certain equipment, routing, software and programming used by AeroVPS are not directly owned or written by AeroVPS. Moreover, AeroVPS holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as AeroVPS sees fit.
By activating your account with AeroVPS, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.
Any abuse, threats, and bad words to any of our staff members will be an automatic suspension or termination of your service without any refunds.

You are solely responsible for the content stored on your service from AeroVPS.

All virtual private servers are unmanaged. The support staff are always willing to assist clients, however, what this means is that we are not obliged to solving the problem or providing a solution. Even though we are unmanaged, other companies would point out to you that they won't help you because of this, we will however try and solve the problem - but as mentioned, we're not obliged to solving the problem and carry no warranty. The user requests assistance from us at own risk.
